General Terms and Conditions
General Terms and Conditions for the Horror Days public event series: The event visitor or ticket purchaser accepts the following terms and conditions as a basis for attending the event. Any agreements deviating from or in addition to these "General Terms and Conditions" must be laid out in writing. Should individual provisions of these "General Terms and Conditions" be rendered ineffective, this shall not affect the liability of the remaining provisions and the contracts concluded on their basis:
1. Conclusion of the contract (ticket purchase)
The booking can

be made via the online shop at the homepage www.horror-days.com, or by phone at --. Based on these T&Cs, an event visit contract is concluded between the ticket purchaser and the organiser. Through the transfer of the ticket or voucher to a third person (owner), the event visit contract (including T&Cs) is also transferred to this person.
The rules on indirect sales do not apply to contracts for the provision of services in the area of scheduled leisure events. The participant therefore has no two-week right of revocation regarding the booked event.

2. Payment
If the ticket price is not paid on time, this entitles the organiser to dissolve the contract and the purchaser will forfeit damages in the amount of the booked tickets.
3. Services
The right to access and attendance exists on the condition that the ticket holder fulfils the event's admission and age requirements and presents a valid ticket.
4. Tickets
All ordered tickets and vouchers remain the property of the organiser until payment has been made in full.
Only tickets purchased through an official distribution channel are considered valid. Copying, altering or imitating tickets is prohibited. All tickets will be checked at the entrance to the event. If there is a suspicion of copied tickets and a conflict with the list of guests designated for the day of the event, there is no entitlement to admission to the event. If a visitor is rejected for this reason, there is no right to a refund of the price paid for the ticket.
Regarding the postal delivery of ordered tickets, the point of sale is liable only up to the point of correct dispatch. The risk of postal delivery is borne by the ticket purchaser.
5. Transfers
The ticket buyer acknowledges that tickets are non-returnable. Re-booking for another event date is possible free of charge up to 1 week before the booked date. Short-term re-booking may be possible upon request with the consent of the organiser, but cannot be guaranteed. The organiser would like to highlight that, depending on the date of the event and the number of tickets, rebooking fees of up to 50% of the ticket price can be charged.
6. Programme changes
We reserve the right to change the programme for good cause, insofar as such changes are reasonable. We reserve the right to make programme changes if an artist cancels, for example because they are ill or are unable to attend the event for other reasons, or if unforeseen circumstances (force majeure, weather and natural conditions) so require. In such a scenario, efforts will be made to ensure that the event will be rescheduled at the earliest possible date.
7. Cancellation by the organiser
If an event has to be cancelled or postponed, the organiser will immediately return the paid event fee. No additional charges will be made for changes resulting from any such cancellation. Further claims are excluded. If the event date is postponed, the ticket will remain valid for the rearranged date of this event. However, the ticket purchaser is entitled to
the statutory right of withdrawal when the event is being postponed. The ticket purchaser is obliged to assert this right of withdrawal to the sales office no later than 1 week before the rearranged date.
8. Data collection and use
The personal data provided by the participant during registration will be stored and processed only for the purpose of carrying out and processing the event and event-related newsletters. The ticket purchaser is expressly informed that this consent can be revoked at any time in writing. By registering, the participant agrees to the storage of their data for this purpose. The participant agrees that the photos, film recordings and interviews made in connection with their participation in the event can be distributed and published without any compensation for broadcasting, television, printed media, books, photomechanical reproductions/video, DVDs etc. In addition, the participant agrees that photos and film recordings may be produced by a production company commissioned by the organiser during the event.
9. Resale
The resale of the ticket - in particular via so-called secondary ticket and auction platforms (i.e. eBay, Viagogo) - is not permitted without written permission from the organiser, in the event that the sale results in a profit exceeding 25% of the purchase price of the ticket. If an unauthorised purchase is discovered, the ticket immediately loses its validity.
10. Warranty
If a performance fails to meet the requirements of the event, a participant must immediately make their complaints known to the organiser on site. Claims for non-performance or non-contractual performance of contractual services must be made to us in writing within two weeks of the conclusion of the event. This also applies if a complaint was raised during the event.
11. General
11.1 During attendance of the event, the making of any sound and/or image recordings by the event visitor is prohibited, unless the organiser has previously given their express consent to such recordings.
11.2 With the purchase of the ticket, the associated house rules of the venue are accepted. The event visitor undertakes to strictly observe all safety and
implementation regulations and all relevant instructions, which are communicated to them in writing or orally by the organiser or their representatives before, during and after the event.
11.3 The event visitor may not bring into the event any objects that could endanger the other event visitors in any way (i.e. glass bottles, knives, weapons, firecrackers).
11.4 The organiser is entitled to
A) deny the event visitor access to the event without compensation or B) to exclude the event visitor from the event during its course if the event visitor does not meet the admission requirements, in particular the age limits envisaged for the event or if the event visitor, despite the request of the organiser or their representatives, fails to comply with the safety and/or implementation regulations of the organiser. The organiser reserves the right to refuse intoxicated persons access to the event or to exclude them from the event during its course if they disturb the event or if they do not comply with the implementing regulations. In such an instance, refund of the ticket price is excluded.
11.5 The organiser assumes no liability for damage to health, which may occur as a result of sound and/or lighting effects in use at events. Any claims for damages are excluded, unless the organiser, their representative or agent has acted with gross negligence or intent.
11.6. Neither the organiser nor the sales outlets can guarantee the correctness and completeness of the displayed event data due to the possibility of transmission errors, technical faults or illegal interventions of third parties and the non-excludable influencing of the ticket distribution system. The ticket purchaser, however, is entitled to a right of withdrawal if the ticket order was made via the ticket portal on the basis of demonstrably incorrect event dates and therefore the demonstrably relevant data (date, prices, places) for the purchase of tickets had to be changed in retrospect by the organiser. Processing fees paid in addition to the ticket price will not be refunded.
11.7. Dogs and other pets may not be brought to the events.
12. Jurisdiction
Unless otherwise laid out in these General Terms and Conditions, the provisions of Austrian law shall apply. For all legal disputes in connection with the ticket order, the ticket purchase and attendance of the event, Sankt Pölten is agreed as the exclusive place of jurisdiction.
